This is an application for condonation of delay in filing the appeal challenging the Judgment and Award dated 11.11.2020, passed by the Member, Motor Accident Claims Tribunal, Kelapur. 3.

The applicant/insurance company has filed the application stating that the delay in filing the appeal occurred on account of several reasons including Covid-19 pandemic and time consumed for obtaining necessary approvals and submissions. It is submitted that there is delay of 60 days, which is unintentional and it needs to be condoned so that the appeal will be heard and decided on merits.

The respondents are served in the civil application, however, nobody appears on their behalf.

Having regard to the contents of the application and submissions advanced, the application is allowed and the delay of 60 days in filing the first appeal is condoned.

Issue notice to the respondents, returnable after four weeks.
