In the present petition, a prayer is for releasing the amount of pension and the same is opposed by the respondent-Western Coalfields Limited (WCL) on the ground that the recovery is directed against the petitioner and the petition challenging such recovery is pending consideration.

In view of aforesaid stand of the WCL, the petitioner has filed a pursis today stating therein that he undertakes to pay the amount of recovery, in case he fails in the writ petition challenging such recovery. 4.
The undertaking given by petitioner by way of pursis dated 31.07.2025 is accepted.

In view of this undertaking, we are of the opinion that now there is no reason to withhold the amount of pension of the petitioner. 6.
In the circumstances, the respondent-WCL is directed to pay the amount of pension accumulated under the CIL Defined Contributory Pension Scheme to the petitioner.

We further direct the respondent-WCL to pay the amount of pension within a period of four weeks from today. 8.
With these observations and directions, the writ petition is disposed of. No order as to costs.
