In this petition, the petitioner has made two prayers. Prayer clause Nos.(i) and (ii) reads as under:

"(i) quash and set aside the impugned order dated 25.10.2024 below Exh.19 in Regular Criminal Case No.62/2022 passed by the learned Judicial Magistrate First Class, Shegaon (Annexure-D) thereby rejected the discharge application filed by the petitioners/accused and further be pleased to;

(ii) quash and set aside the impugned charge-sheet bearing No.31/2022 dated 20.05.2022 (Annexure-A) for the offences punishable under Section 417, 420 Read with 34 of Indian Penal Code registered as Regular Criminal Case No.62/2023 pending on the file of learned Judicial Magistrate First Class, Shegaon, District-Buldhana."

Insofar as prayer clause No.(i) is concerned, the learned counsel for the petitioner submits that he is not pressing the prayer clause No. (i). Insofar as prayer clause No.(ii) is concerned, he will pursue the same with the Division Bench as the matter for quashing of charge-sheet lies before the Division Bench. In this view of the matter, the petition is disposed of with liberty to avail the remedy as is available in law.
