Since the issue involved in these writ petitions is identical and similar prayers are made therein, they are heard together and are decided by this common order.
By these writ petitions the petitioners seek a direction against the respondents to release the grant-in-aid due and payable to the petitioners for running the Balgruhas.
The learned Additional and Assistant Government Pleaders appearing on behalf of the respondents state that similar petitions came up for consideration before the Aurangabad Bench of the Bombay High Court and the Division Bench at Aurangabad by the judgment, dated 27.06.2016 in Writ Petition No.11237 of 2015 (Shobhana Sikshan Sanstha and others v. The State of Maharashtra and others) has partially allowed the writ petitions and issued certain directions against the respondents. It is stated that similar orders may be passed in these writ petitions also.
On hearing the learned counsel for the parties and on a perusal of the judgment, referred to herein above, we find that the issue involved in these writ petitions and the decided writ petitions is the same.
Hence, we partly allow these writ petitions and direct the concerned Department of the State Government to ensure the disbursement of the grant-in-aid to the petitioners-institutions for running the Balgruhas as per the entitlement, after verifying the original record. The respondents are directed to verify the records as expeditiously as possible and positively within ten weeks. The arrears of grant-in-aid should be released in favour of the eligible petitioners within twelve weeks from the date of this order. On parity, we observe that the Department of Women and Child Development, Department of Finance and the Chief Secretary of the Government of Maharashtra would be jointly responsible for the implementation of the directions. Order accordingly. No costs.
