DATED : JUNE 19, 2017 Shri Chaware, learned Counsel for petitioner, submit that challenge in this petition is to grant of maintenance of Rs.200/- per month to petitioner and during pendency of present petition, petitioner had also filed revision, which came to be dismissed and said order is impugned in this petition. It is, however, contended that pending this petition, petitioner filed application under Section 127 of Code of Criminal Procedure and prayed for enhancement of amount to Rs.300/- per month.
Learned Counsel for both sides have submitted that said application must have been decided and in view of subsequent developments as aforesaid, petition by passage of time is rendered infructuous. Shri Chaware, learned Counsel for petitioner, therefore, seeks leave to withdraw this petition. Leave as prayed is granted. The criminal
