Heard learned counsel for the rival parties.

The applicant is prosecuted in Crime No.

39/2014 for an offence punishable under Sections 307, 201 read with 34 of the Indian Penal Code registered with Police Station, Badnera.

Admittedly, the chargesheet has been filed. The applicant is in jail from 27.05.2014. I have perused the injury report. I have also perused the statements. I find that though the injury was caused on the head, it does not appear to be that much grievous and looking to the tenor of the statements, the case is one of quarrel between brothers and their children though the undoubtedly, the applicant and his children overpowered the victim.

ba225.15 Be that as it may. Since the applicant is in jail for the last one year, it would be appropriate to make the following order.

ORDER

(i) Criminal Application No.225/2015 is allowed.

(ii) The applicant-Prakash Bankar be released on bail on his executing PR bond in the sum of Rs.10,000/- with one surety in the like amount. (iii) The applicant shall attend Police Station, Badnera once in a week and shall cooperate the Investigating Officer.

(iii) The applicant shall not tamper with the prosecution evidence.
