(2) Heard Shri A.S. Londhe, learned counsel for applicant and Shri K.L. Dharmadhikari, learned Additional Public Prosecutor for the non-applicant/State in detail. (3) This is an offence in which the applicant has alleged to have raped a mentally challenged girl. (4) After hearing both the learned counsel, when the Court was about to dismiss the application, Shri Londhe, learned counsel for the applicant submits that he be permitted to withdraw this application with liberty to file afresh bail application if the trial does not proceed.

(6) Since learned counsel for the applicant is withdrawing this application, the Court is not giving detailed reasons for its dismissal.
