Heard Mr. Khamborkar, learned counsel for applicant, Mr. Rode, learned A.P.P. for non applicant-State and also Mr. Mishra, learned counsel for intervenor. After hearing learned counsel for applicant, when this Court was about to dismiss application, Mr.Khamborkar, learned counsel for applicant, submits that he be permitted to withdraw the present application. He further submits that liberty be granted to him to file an application if trial is not decided expeditiously. Application is dismissed as withdrawn with liberty to the applicant that if the case in which the applicant is an accused is not decided within a period of 1 1⁄2 years from today, he will have liberty to move an application afresh before this Court. The order be communicated to the counsel appearing for the parties either on the e-mail address or on WhatsApp or by such other mode, as is permissible in law.
