Heard Shri D.B.Patel, advocate h/f. Shri H.S. Rahangdale, advocate for the applicant and Shri R.S.Nayak, A.P.P. for the non-applicant.
The applicant is arrested on 14th September, 2015 in crime registered against him for the offences punishable under Sections 302, 323, 504, 498-A of the Indian Penal Code.
The marriage between the applicant and his deceased wife was performed on 21st April, 2007. The incident has taken place on 15th September, 2015. The couple has three years' female child.
According to the prosecution, the applicant and his deceased wife were leaving in the house occupied by the members of the joint family and at the time of incident father of the applicant and daughter of brother of the applicant were present in the house.
The charge-sheet is filed on 26th November, 2015. The investigation is complete. The non-applicant has
2 ba251.16 not been able to show that the custody of the applicant is required for further investigation.
Considering the facts on record, in my view, the applicant is entitled to be released on bail. Hence, the following order :
The applicant having been arrested in Crime No. 102 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.Twenty Five Thousand and two solvent sureties in the like amount.
The application is allowed accordingly.
