The applicant is being prosecuted for the offences punishable under Section 307, 326, 506, 504 read with 34 of the Indian Penal Code. It is not in dispute that the chargesheet has been filed. The applicant is in jail since the date of arrest i.e. 3-12-2014.

With the assistance of the learned counsel for the parties, I have seen the medical certificate. There are as many as 7 injuries, but Doctor has certified that all of them are simple injuries though by means of sharp portion of axe as alleged by the prosecution. Thus the requisite for attempt to commit murder prima facie does not exist from the injury certificate. That being so, I make the following order.

ORDER

(i) Criminal Application (BA) No. 227/2015 is

(ii) The applicant be released on bail on his personal bond of Rs. 5,000/- with one solvent surety in the like amount.

(iii) The applicant shall report to the Police Station, Pombhurna, District Chandrapur once in a month on start Sunday between 11.00 a.m. to 4.00 p.m.
