Perused FIR. We are not in position to accept at this stage the contention that no offence under Section 379 read with Section 34 of the Indian Penal Code is made out against the applicant. However, we leave all the contentions raised by the learned counsel for the applicant open for evaluation at appropriate stage. With this observation and with liberty to raise these contentions at appropriate stage, we dispose of the petition. No costs.
