The applicant is apprehending arrest in Crime 230/2018 registered at Police Station Frezarpura, Amravati for offence punishable under section 420 and 406 of the Indian Penal Code.

The first information report is lodged by one Ramesh Khorgade on 27.02.2018, the gist of which is that he was induced to pay Rs.25 lakh to the applicant who promised to use his proximity with then Civil Aviation Minister to secure employment for the son of the informant. According to the informant, he paid the amount in 2013. The further allegation is that since the son of the informant did not clear the examination for the job of pilot in Jet Airlines, he demanded the refund of the money and the accused failed to do so. The result of the examination is alleged have been declared on 30.01.2016.

The submission of the learned counsel

aba186.18.O.odt 2 Shri Akshay Naik that the report is high belated, prima facie, is not without substance. Be that as it may, the effect of the delay is a matter to be decided by the Trial Court after the evidence is recorded. The learned counsel Shri Akshay Naik states, on instructions, that without prejudice to the contention that he did not receive any amount from the informant by promising to secure employment in Jet Airlines, the applicant shall deposit Rs.25 lakh with the Trial Court, in two installments on 11.08.2018 and 11.10.2018. I am inclined to exercise discretion in favour of the applicant.

The application is allowed.

The interim order dated 20.03.2018 is confirmed.

The applicant shall abide by the conditions of the interim order till the filing of the charge-sheet. JUDGE NSN
