After the non-applicant has filed reply matter was listed on 15th June, 2017 on which date it was adjourned on request made by the Advocate appearing for the applicant. Today there is no appearance for the applicant.
The applicant is arrested on 18th August, 2016 in connection with Crime No.86/2016 registered against 3 accused (including the applicant) for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code, Section 4/25 of the Arms Act and Section 135 of the Maharashtra Police Act.
The learned A.P.P. has pointed out that there are eye witnesses who have referred the name of applicant and also about the role played by the applicant. It is submitted that the C.C.T.V. footage also shows the presence of applicant at the time of incident. It is
2 ba291.17 pointed out that earlier 6 crimes for the offence punishable under Sections 457, 380, 307, 452, 294, 506-B, 323, 427, 324, 504 of the Indian Penal Code and for offences under Arms Act and Maharashtra Police Act are registered against the applicant. In the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed.
