Heard Shri M.M. Agnihotri, the learned Advocate for the applicant and Ms. Maldhure, the learned AGP for the non-applicant nos. 8 and 9.

As per the order passed by the learned Registrar on 22nd January, 2013, the application has abated against non-applicant nos. 5 and 7. The non-applicant nos. 1, 2, 3, 4 and 6 are related to the non-applicant nos. 5 and 7 and the land acquired was jointly held by the non-applicant nos. 1 to 7. As the award has attained finality as far as the non-applicant nos. 5 and 7 are concerned, it would not be possible to modify it. Therefore, the application is dismissed as abated. Consequently, the appeal also stands abated. No costs. In view of disposal of Civil Application (F) No.2022/2011 and the First Appeal St. No.7020/2011 has abated, the civil application No. 2023/2011 is rendered infructuous at this stage. JUDGE Ambulkar
