In view of the statement made in affidavit-in-reply filed by respondent No.2 that auction could not take place on 28/03/2016, without prejudice to his contention in the petition, Shri Naik, learned Counsel for petitioner submits that petition may be disposed of by giving petitioner liberty to take appropriate steps in accordance with law in the matter. Shri Bhattad, learned Counsel for respondent No.2 points out that petitioner has got alternate remedy raising objection before respondent No.2 itself.

As the auction is cancelled, we find that petitioner can take appropriate measures in accordance with law for redressal of its grievance. Keeping all its contentions open and with said liberty, we dispose of writ petition. No costs. JUDGE JUDGE *sdw
