O R D E R
(Passed on 13th August, 2022) Appellant is personally present and he has been identified by Shri Mirache, learned counsel, Shri Limaye, learned counsel on behalf of the Insurance Company.
We interacted with both the parties. They have confirmed that the matter is amicably settled between them and thereby Insurance Company has agreed to pay additional compensation of Rs.2,30,000/- to the appellant by depositing it in this Court within 60 days from today. The settlement arrived at between the parties, is on following terms.
"The present appeal is settled between the appellant and the Insurance Company/Respondent no.2 on the condition that the insurance company agrees to pay the additional amount of Rs.2,30,000/- (Rs.Two Lakhs Thirty Thousand Only) towards full and final settlement within the period of 60 days from the date of award, failing which Insurance Company agrees to pay the interest of 7.5% pa from the date of award till realization of the amount. The amount may be given to the appellant." Accordingly, the appellant does not want to proceed further. In view of that, settlement is accepted. The appeal is disposed of as settled. Court fee, if any, be refunded as per Rules.
On deposits of amount of compensation as per the settlement by the Insurance Company to this Court within 60 days from today, the appellant is permitted to withdraw the amount.
