Heard Shri C.G.Barapatre, advocate for the applicant and Shri N.S.Khubalkar, A.P.P. for the nonapplicant. The applicant is arrested on 24th October, 2015 in crime registered against him and other accused persons for the offences punishable under Sections 302, 365, 143, 149 and 34 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

As far as the applicant is concerned, the case of the prosecution is based on circumstantial evidence. The investigation is complete. Charge-sheet is filed. Co-accused Dattu Mohitkar and Sanjay Girsawale are released on bail. Considering the facts on record, in my view, the applicant is entitled to be released on bail. Hence, the following order :

2 ba258.16 The applicant having been arrested in Crime No. 250 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.Twenty Five Thousand and one solvent surety in the like amount.
