This is State Appeal challenging the order of acquittal passed in Summary Criminal Case No.290/2014, thereby and under which the trial Court acquitted the sole accused for the offence punishable under Sections 279, 304-A of the Indian Penal Code and Section 3 read with Sections 181 and 184 of the Motor Vehicles Act. 3.

Perusal of the judgment reveals that the accused has not disputed his presence and that

Order 1412appa266.20 he was driving the motor cycle at the relevant time. Prosecution witness no.2 Atish Ramteke appears to have deposed about the rash and negligent driving by the accused.

Having regard to the said fact and other material, the matter requires reconsideration. Leave granted as prayed for.
