Heard learned counsel for the petitioners.

Learned counsel for the petitioners submits that the matter bearing CAFST No.15636 of 2018 in First Appeal St. No.15635 of 2015 came to be disposed of before the National Lok-Adalat only on the ground that the rate granted by the learned Reference Court was less than four times the rate granted by the learned Land Acquisition Officer. He submits that due to miscalculation placed before the National Lok-Adalat, the appeal was withdrawn. He further submits that on the proper and correct calculation, it revealed that the rate granted by the learned Reference Court is in fact more than four times the rate granted by the learned Land Acquisition Officer, and therefore, the appeal ought not to have been withdrawn.

In view of the above, the award dated 08.12.2018 passed by the National Lok-Adalat is hereby quashed and set aside.

First Appeal St. No.15635 of 2018 is restored to its original position.

First Appeal St. No.19218 of 2017 to be heard alongwith First Appeal St. No.15635 of 2018.
