IN THE HIGH COURT OF JUDICATURE AT BOMBAY

and Registrar's Orders.
-------------------------------------------------------------------------------------------------------------------------------- Shri S.P. Bhandarkar, Advocate for the applicant. Shri M.K. Pathan, APP for the Respondent-State CORAM: S.B. SHUKRE, J DATE: 03-05-2018 Pursis produced before the Court alongwith documents annexed to it by the learned Counsel for the applicant, a copy of which has already been furnished to the learned Counsel for the applicant, is taken on record.
Heard. Perused the Pursis and documents annexed to it.
There is no dispute about the fact, as indicated by the Pursis and the documents, that the applicant has cooperated with the Police in the investigation. Her specimen signatures have been obtained and she has also given her reply to the
aba188.18 905.odt 2 questions put to her by the Investigating Officer. It thus appears that the only ground, the ground of custodial interrogation, on which this application was opposed earlier, now no longer survives. The purpose of custodial interrogation has been served by not only attendance of the applicant at the police station, but also by her cooperating with the police in the investigation. There is no dispute about this fact. The charge-sheet has also been filed. All other accused have been released on bail. One of them, Kunal Ghotekar, stated by the prosecution as the main accused, has in fact been released on anticipatory bail.
In this situation, I am of the view that no purpose is going to be served by refusing anticipatory bail to the applicant.
In the result, the application is allowed.
The interim anticipatory bail granted to the applicant on 26-04-2018 is hereby confirmed on the same conditions with clarification that now the applicant, after period of attendance is over, shall attend the
aba188.18 905.odt 3 Police Station as and when required by the Investigating Officer.
Disposed of accordingly.
