3] The learned counsel for the petitioner has placed on record the copy of notice issued to respondent 2 by Whatsapp.
4] The learned counsel Shri Nandeshwar states that the notice was sent on the cell phone of the respondent 2. The statement is accepted.
5] By order dated 15.05.2020 this Court (Coram:
Amit B. Borkar, J.) directed the Divisional Commissioner,
wp1782.20.O.odt Nagpur to decide Appeal 74 of 2020 within six months and granted ad-interim relief during the pendency of the said appeal.
6] The issue which is pending in the statutory appeal is whether the petitioner can be disqualified for the delay and/or failure to furnish caste validity certificate. 7] Considering the issue involved and the order dated 15.05.2020, this petition can be disposed of. 8] The Divisional Commissioner, Nagpur shall finally decide Appeal 74 of 2020 on or before 15.11.2020. The interim relief granted by this Court vide order 15.05.2020 shall continue to operate during the pendency of the appeal.
9] The petition is disposed of in the afore-stated terms.
10] The order be communicated to the counsel appearing for the parties, either on the e-mail address or on WhatsApp or by such other mode, as is permissible in law. JUDGE NSN
