Heard Shri A.J.Mirza, advocate for the applicant and Shri R.S.Nayak, A.P.P. for the non-applicant. The applicant is arrested on 21st February, 2016 in crime registered against him for the offence punishable under Sections 324, 405, 506 of the Indian Penal Code and Sections 4 and 25 of the Indian Arms Act, 1959. The non-applicant has given details of injuries suffered by the victims in paragraph 3 of the reply as follows : "3. That, injured persons were referred for medical treatment. The injury certificate of Manohar reveals contuse lacerated wound on base of first web. Similarly injury certificate of Khushal reveals 3 abrasion injuries base of first web space forehead and abdomen.

Injuries are simple in nature."

Considering the nature of accusations against the applicant and the details of the injuries and as the nonapplicant has not been able to show that the custody of the

2 ba260.16 applicant is required for further investigation, in my view, the applicant is entitled to be released on bail. Hence, the following order :

The applicant, having been arrested in Crime No.18 of 2016 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.Ten Thousand and one solvent surety in the like amount.
