In morning session this petition was heard extensively. In this writ petition, the petitioner is challenging the order passed by learned Civil Judge, Junior Division, Dhamangaon Railway dated 02.03.2020 appointing T.I.L.R. for measurement of the land of both petitioner as well as respondent.

(2) During the course of submission, counsel for the respondent Shri Siddique pointed out that in pursuance to the order dated 02.03.2020 T.I.L.R. has already conducted joint measurement of both properties belonging to the petitioner as well as respondent, however the report is awaited.

(3) Upon such submission, Shri Alok Daga, learned counsel for the petitioner submits that matter may be taken

(4) Accordingly, in the second session, when matter was called, Shri Daga, learned counsel submits that the statement of Shri Siddique is absolutely right and correct. In that view of the matter, he submits that he wish to withdraw the present writ petition.

(5) The writ petition is disposed of as withdrawn. No order as to costs.
