Shri U.J. Deshpande, the learned counsel for the applicants, submits that the matrimonial disputes between the husband and the wife are likely to be referred to the mediation and not only that there is strong likelihood of the compromise taking place in the mediation. He submits that, in that event, a compromise decree is also likely to be passed. The applicants are the relatives of the husband so also of respondent no.2 and, as a matter of fact, they have nothing to do with the matrimonial dispute between the husband and the wife and were unnecessarily involved. He, therefore, submitted that the necessary term for compounding of the criminal offence against the applicants would also be inserted in the compromise decree in case the mediation succeeds.
We are of the opinion that unless and until the mediation succeeds and the compromise decree is actually passed by the Competent Court as contended by Shri Deshpande and further a certified copy thereof placed on record, it would not be possible for us, at this stage, to quash the F.I.R., as prayed for. In that view of the matter, we make the following
apl268.12 2/2 order:- Order Criminal Application (APL) No.268/2012 is disposed of, reserving liberty in favour of the applicants to file such other application, as is advised, after culmination of the matrimonial proceedings along with the certified copies.
