The applicant is arrested on 28th October, 2016 in crime registered against him for the offence punishable under Sections 406 and 420 of the Indian Penal Code on the complaint that alluring the complainant of giving substantial profits from the business, the applicant has cheated the applicant and though cheques were issued in the name of the complainant, initially the complainant was asked not to deposit the cheques and then the applicant could not be traced.

The application is opposed on the ground that the wife of the applicant is not traceable.

The investigating agency has not been able to point out that the custody of the applicant is required for further investigation.

Considering the nature of accusations against

2 ba296.17 the applicant and the facts of the case, in my view, the applicant is entitled to be released on bail, however, on conditions as imposed by this order.

The applicant having been arrested in Crime No.182/2016 registered by the non-applicant, he be released on bail on furnishing cash security of Rs.1 Lakh and two solvent sureties in the like amount.

The applicant shall deposit his passport with the non-applicant No.1 before he is released. The application is allowed accordingly.
