Interim maintenance was granted by the trial Court by an order passed below Exh.5 on 01.10.2022, whereby an amount of Rs.2000/- was granted to the Wife, so also an amount of Rs.2000/- is granted to the Daughter. The said order was assailed before the Appellate Court by filing an appeal under Section 29 of the Domestic Violence Act. Said appeal came to be dismissed on 19.08.2024, against which the present Writ Petition is filed.

The only ground raised by the petitioner is that the respondent no.1 is not a legally wedded wife of the petitioner.

At this junction, it is necessary to mention that the original proceedings are still pending for adjudication before the Civil Judge, Junior Division, Wardha. Unless and until the parties led evidence to that effect, it is very difficult to accept the contention of the petitioner that the respondent no.1 is not a legally wedded wife of the petitioner. Secondly, the appeal challenging interim maintenance granted @ Rs.2000/-, is dismissed by the Appellate Court after considering the contention of the petitioner. I find no reason to interfere in the interim maintenance order passed by the trial Court. In this view of the matter, Criminal Writ Petition is dismissed.
