It is common ground that before filing of the petition the charge has already been framed. In view of the decision in the case of Ratilal Bhanji Mithani Vs. State of Maharashtra and others1, wherein it has been held that once charge is framed the Magistrate is required to proceed with the trial. 3.

In view of this legal position, the petition is not maintainable. Accordingly, it is dismissed.
