The petitioner is permitted to withdraw the petition with liberty to approach the learned Charity Commissioner for sanction, afresh.

It is made clear, that if such an application is preferred, the same shall be treated on its own merit and as a separate and fresh application unconnected with whatever has transpired. It is further made clear that the prospective purchaser in the earlier round of litigation shall have no preferential right as such and shall be treated at par with others who are interested in purchasing the trust land. 4.

The petition is dismissed as withdrawn in the aforestated terms.
