Heard.

The present applicant has filed the present application seeking suspension of sentence and grant of bail on the ground of parity.

This Court vide order dated 19.03.2018 in the application filed by the main accused has already found that the said applicant was entitled to suspension of sentence and grant of bail.

Insofar as applicant in Criminal Appeal No.164/2017 is concerned, he was directly named by star witness i.e. P.W.1. The role attributed to the present applicant is that of accompanying the main accused and assisting him in assault on the deceased.

In that view of the matter, we find that the case

appa261.18.O.odt 2 of the present applicant stands on the same footing as that of the applicant in Criminal Appeal No.164/2017. The application is allowed on the same terms and conditions as are imposed by this Court on 19.03.2018. JUDGE JUDGE NSN
