The learned advocate for the appellant/ claimant and the respondent-M.S.R.T.C. submit that the award passed by the tribunal is challenged only by the claimant for enhancement of the amount of compensation and the respondent-M.S.R.T.C. has not challenged the impugned award.

Considering the facts of the case and accepting the submissions made in the civil application, the appellant/ claimant is permitted to withdraw the amount deposited by the respondent-Corporation along with interest, if any. The same be given to the appellant immediately.

The civil application is allowed accordingly. No costs.
