17th May, 2016 The present application has been filed under Section 439 of the Criminal Procedure Code.

The Applicant has been arrested on 18th November, 2015 in relation to Crime No. 235/2014 for offences punishable under Sections 420, 467 and 468 read with Section 34 of Indian Penal Code.

It is submitted that the Accused No.1 - Mahendra Maheshkar was released on bail by this Court in Criminal Application No. 114 of 2016 by order dated 12th April, 2016. It is further submitted that since the charge-sheet has been filed in the offence, there is no impediment in granting bail to the applicant.

The application is opposed by the learned Addl. Public Prosecutor, on the ground that two other crimes were registered against him and on that count, the bail came to be refused.

Heard.

Considering the fact that charge-sheet has been filed and Accused No.1 has already been released on bail, the following order is passed:-

O R D E R

[a] The Application is allowed.

[b] The applicant is directed to be released on bail in regard to Crime No. 235/14 on furnishing a Personal Bond of Rs.25,000/- [rupees twenty-five thousand only] with two solvent sureties in the like amount.

[c] The Applicant shall attend the Sessions Trial on every date unless he is granted exemption.
