These two applications have been filed by the applicants for condonation of delay of 316 days in filing the application for restoration of Criminal Application No.829/2015 and for recalling the order dated 04/04/2019 and for restoration of Criminal Application No.829/2015. 2.

The order dated 04/04/2019, by which, the application was dismissed with a costs of Rs.3,000/- is claimed to have been deposited on 02/12/2020.

Shri Damle, the learned Additional Public Prosecutor for the respondent has no objection and considering the reasons given, the applications are allowed. Criminal Application (APL) No.829/2015 is restored to its original file.

List Criminal Application (APL) No.829/2015 for final hearing in the week commencing 06/06/2022. 5.

It is made clear that in case in future if the matter is dismissed for default, the Court shall not consider the application for restoration.
