ATE : FEBRUARY 05, 2025 1) Heard Ms.Himani Kavi, learned counsel for the petitioner.
2) The petition questions the decision of the Caste Scrutiny Committee dated 01/02/2024, rejecting the claim of the petitioner belonging to the "Thakur", Scheduled Tribe (pg.141). 3) Though it is contended by learned counsel for petitioner that all the entries in the relevant documents indicate that the family of the petitioner belonging to "Thakur", Scheduled Tribe, we however, find from perusal of the impugned decision that the rejection of the claim of the petitioner, was on the ground that the tribe claim of his father Pralhad Narayanrao Chavan was rejected by the Committee by its order 10/12/1999, against the said order, Writ Petition No.2239/2000 filed by him came to be dismissed for want of prosecution by the learned Division Bench of this Court on 27/11/2014; so also the fact that the tribe claim of the cousin brother of the petitioner, namely, Vijay Ramchandra Chavan of belonging to "Thakur", Scheduled Tribe was also
2 15-wp 2336.2024.doc rejected, Writ Petition No.4477/2008 against the same order also came to be dismissed by this Court on 01/08/2018, S.L.P. against which is pending. It also records that the father of the petitioner in his affidavit dated 04/01/2020 filed before the Committee in Form-F suppress this position and has also furnished false information.
4) In view of the rejection of the tribe claim of the father of the petitioner by the Committee, which has attained finality on account of the dismissal of the Writ Petition No.2239/2000, we do not see any reason to entertain a challenge to the impugned decision. The petition is dismissed, however, with costs of Rs.25000/- to be paid to Raman Science Centre, Nagpur, the bank details of the same are as under :- "Name :- Raman Science Centre and Planetarium, Nagpur Account No. : - 0306101022235 Name of Bank :- CANARA BANK Branch Name & Address :- Sitabuldi Branch, Nagpur IFSC Code :- CNRB0000306 MICR CODE :- 440015002"
