DATED : 24 MARCH, 2015 Prayer is to condone delay of 261 days in filing first appeal stamp No.7059/12 under Section 173 of the Motor Vehicles Act, 1988.

The applicant/appellant is Insurance Company. It appears that after proceedings were filed, on account of some technical objections, registration was refused and then this Court was required to consider that refusal. In the process, the Insurance Company was directed to deposit the amount as per award and on 27/02/2014 the claimants have been permitted to withdraw an amount of Rs.10 lac. They were also permitted to move appropriate application for

In this situation, with consent of the parties, delay is condoned. Registry to register the first appeal. The respective Counsel S/Shri Harkare and Joharapurkar waive notice for the respondents.
