DATED : APRIL 21, 2016 Heard learned Counsel for the petitioners.
By this petition the petitioners challenge legality and correctness of the order dated 18/3/2016 directing the petitioners to proceed first on the preliminary issue of jurisdiction.
In view of the provision of Section 9 of the Code of Civil Procedure, creating a presumption regarding existence of jurisdiction to try all suits of civil nature, unless barred expressly or by necessary implication, I see no illegality or perversity in the impugned order. No interference with the impugned order is warranted. Writ petition is dismissed summarily.
