Heard Shri R.M.Daga, advocate for the applicant and Shri A.D.Sonak, A.P.P. for the non-applicant. The applicant is arrested on 20th November, 2015 in crime registered against him and other co-accused for the offences punishable under Section 302, 201 read with Section 34 of the Indian Penal Code.

The case of the prosecution is based on the circumstantial evidence. The investigation is complete and chargesheet is filed on 11th February, 2016. Co-accused Sanjay Bhardwaj is released on bail. The non-applicant has not been able to show that the custody of the applicant is required for further investigation.

In the above facts, in my view, the applicant is entitled to be released on bail.

Hence, the following order :

2 ba265.16 The applicant, having been arrested in Crime No.231 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. bond for Rs.Twenty Five Thousand and one solvent surety in the like amount. The applicant shall attend the sessions trial regularly on every date unless granted exemption by the Sessions Court.
