Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.

Heard.

There is a direction given by this Court on 06/11/2020 to the Reference Court to disburse the amount to respondent Nos.1 & 2 by doing personal verification as per rules. The amount lying in this Court is also transferred to the Reference Court. On knowing that fact, on 01/02/2021 both these claimants have applied before the Reference Court, Daryapur, Amravati. The Reference Court has called for the say of A.G.P. and till today, the application is not decided. There may be a reason of pandemic situation, however, when this Court has directed to disburse the amount as per order dated 06/11/2020, what was left to

cao.331.21 2/2 the Reference Court is to take personal verification as per the rules and to disburse the amount. This Court finds very strange that why the amount is not disbursed till today. Hence, strict directions are required. Hence, the order :

i.

The Civil Judge Senior Division, Daryapur, Amravati is directed to release the amount in favour of the applicants in M.J.C. No.3/2021 at the earliest and not more than seven days on receipt of the order of this Court.

ii.

If the Reference Court has got any reservation that is to say about compliance of the rules, thereafter, the same may be mentioned.

iii.

If this direction of disbursing the amount within seven days is not complied, this Court will be compelled to take some strict view.

iv.

Authenticated copy of this order be given to the respondents.

v.

The application is disposed of.
