There was a delay of 42 days in preferring an appeal and that is why the present appellant has filed delay condonation application having Stamp No. 26907/2017. The learned Registrar (Judicial) refused registration by the end of 06.02.2018. It was for non-removal of the office objection.

The appellant was earlier represented by different advocate. However, due to leaving the profession, the appellant appointed new advocate. In the meantime, the matter could not be pursed.

There is a delay of 1177 days. Even though it is explained, certain costs is required. Hence, the order :-

1] Delay of 1177 days in filing restoration application is condoned subject to deposit of costs of Rs. 2,000/- in this Court. 2] The proceeding at Stamp No. 26903/2017 be restored.
3] Civil Application is disposed of.
4] Costs to be deposited within the period of two weeks. 5] Appellant to remove the office objections within the period of two weeks.
