NAIK & A.M.BADAR, JJ DATE : 24.4.2015 The learned counsel for the applicant states that though there is no delay in filing the appeal, the office has unnecessarily raised the objection. It is stated that this court has held in the order dated 25th April, 2007 in Civil Application No. 88/2007 in the Family Court Appeal Stamp no. 8906 of 2007 that the Family Court Appeal under Section 28 of the Hindu Marriage Act read with Section 19 of the Family Court Act could be filed within a period of 90 days. On perusal of the order dated 25th April, 2007, we dispose of the civil application by observing that there is no delay in filing the first appeal stamp no. 7233 of 2015. Civil Application stands disposed of.
