Heard Shri Gaikwad, learned Counsel for the applicant/original petitioner, Shri M.J. Khan, learned A.G.P. for non-applicant no.1 and Shri V.G. Wankhede, learned Counsel for non-applicant nos. 2 to 4.

The observations in paragraph no.8 of judgment dated 08.03.2017 in Writ Petition No.1750/2013, that respondent no.4 had been working, appear to be an error. However, that error by itself is not sufficient to grant relief as prayed for by the applicant in review application.

In this situation, it appears that one post of Junior Conductor is already available and lying vacant. Similarly, as per judgment dated 08.03.2017, we have directed respondent - employer to accommodate applicant against any vacant post either as junior conductor or any equivalent post.

We grant liberty to respondent nos. 2 and 3 employer to provide work to applicant as also nonapplicant no.4, either as junior conductor or any other equivalent post.

Accordingly, Civil Application is partly allowed and disposed of. No costs.
