DATED : 02/05/2019 Heard learned Advocate Shri Gandhe for the applicant. He has pointed out statement of wife of deceased dated 16.03.2018 in which she has stated that on 08.03.2018 at about 07.00 p.m. her husband came to his house under the influence of liquor and quarreled with her. She was directed to go out alongwith children. When she returned back at about 08.00 p.m., her husband was seating. He told her that he was beaten by Narendra Surendra Puri, Akash Dilawar Puri and Yogesh Rajesh Sarnaik by iron pipe. They broke the door of the house and he sustained injuries due to falling of the door on his head. 2.

Learned Advocate for the applicant pointed out her statement recorded under Section 164 of Cr.P.C. 3.

Mrs. Deshmukh, learned Additional Public Prosecutor for the State/non-applicant has strongly objected the present application.

Four accused are released on bail. In the present case, allegations against the accused/applicant are like the same. Hence, the following order.

Criminal Application is allowed.

The applicant be released on bail on his executing a P.R. Bond in the sum of Rs.25,000/- with one solvent surety of the like amount on the following conditions.

(a) The applicant shall not tamper with the evidence of prosecution witnesses.

(b) The applicant shall attend the trial Court on each and every date.

(c) The applicant shall not leave the jurisdiction of trial Court without prior permission.
