DATED : 20 JULY, 2016 Heard learned Senior Counsel for the applicant and learned A.P.P. for the State. Perused the first information report and the case diary. It is seen from the record that the offence of abetment of suicide punishable under Section 306 of the Indian Penal Code has been registered against this applicant only on the basis of what some of the witnesses have said. These witnesses have said that this applicant and another person by name Gajanan Ghuge were harassing the deceased. No details about the nature of harassment given to the deceased have come on record. This applicant is working as Extension Officer and the deceased worked under him as Gramsevak. No material regarding filing of

complaint previously by the deceased is present on record. In these circumstances, it is, prima-facie, doubtful if any offence punishable under Section 306 I.P.C. would be made out. The applicant is, therefore, entitled to be released on bail.

The application is allowed and the interim bail granted to the applicant by this Court on 01/4/2016 is hereby confirmed on the same conditions with addition of the conditions that the applicant shall attend the concerned police station as and when required and shall not tamper with the prosecution witnesses.
