Shri P.V.Navlani, learned counsel for the petitioner submits that, the respondent has agreed to pay Rs.70,000/- (Rs. Seventy Thousand only) which his client is ready to accept. 2.

It is further submitted that the dispute will now remain of Rs. 40,000/-. Accordingly, he wants to withdraw the present proceedings, with liberty to file appropriate proceedings if so advised, in respect of disputed amount of Rs. 40,000/-. 3.

Permission is granted to withdraw the present proceeding with liberty as sought for.

The learned counsel for the respondent shall deposit the Demand Draft of Rs. 70,000/- with the Registry of this Court forthwith and on such deposit, the petitioner is permitted to withdraw the same.
