Perused the reply of the prosecution and the charge-sheet.

It appears that the prosecutrix, who was aged about 16 years at the time when the incident took place, has been changing her stand from time to time. Initially, she said that the physical relations were without her consent and later on she said that they were with her consent. She also says that the physical relations took place not as an exception, but on regular basis.

Considering her age and level of maturity, I am of the view that this is a fit case for grant of regular bail, especially when the investigation is complete.

ba.298.18 2/2 The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.30,000/- together with one solvent surety in the like sum on the conditions that the applicant shall co-operate with the trial Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses in any manner. The application is disposed of in the above terms.
