Shri M.M. Sudame, learned counsel for the petitioner and Shri Ekre, learned AGP for respondent No. 1. The petitioner knowing fully well that it does not satisfy eligibility conditions, participated in tender process and after the happening of inevitable and pending of commercial bids of Respondent Nos. 3 & 4, has approached this Court at this stage when the work orders are to be issued to Respondent Nos. 3 & 4.

Writ Petition has been filed on 31.03.2016. The tender notice is dated 25.01.2016 and the tender form was, therefore, with the petitioner since then and it had knowledge of all conditions.

During hearing, we find that at Aurangabad Bench, similar challenge has been dismissed on 01.03.2016 while deciding Writ Petition No. 1491 of 2016 (M/s. Vishal Intelligence Security Services vs. The State of Maharashtra & Anr.).

In the light of reasons recorded at Aurangabad

0104wp2085.16 Bench and as we find the approach belated, with liberty to the petitioner to take such other steps as are open in law, we dispose of the present writ petition. However, there shall be no order as to costs.
