Panjabrao S/O Ramrao Solanke v. State Election Commission, Maharashtra State, Mumbai And 5 Others
15.4WP.2073.15
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR WRIT PETITION NO. 2073 OF 2015.
Panjabrao s/o Ramrao Solanke .vs. The State Election Commission, Maharashtra & others Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
Mr. H.D. Dangre, Advocate for petitioner, Mr. S.A. Saoji, Advocate holding for Mr. V. Sawarkar, Advocate for respondent no. 1.
Mr. M.K. Pathan, A.G.P. for respondent nos. 2 to 5. CORAM : B.P. DHARMADHIKARI & S.B. SHUKRE, JJ. DATED : APRIL 15, 2015.
The polling is scheduled on 22.4.2015 and submission is that it is being held without publishing voters' list. Letter given by Talathi to petitioner is being relied upon to urge that voters' list was never published.
The elections are to a Village Panchayat and, therefore, regulated by statute. Petitioner has not in any of his representations sent to responsible authorities of Election Commission or to Collector complained that voters' list was not published. At this stage, our attention has been drawn to representation dated 4.4.2015. It only shows the grievance against Talathi.
As large scale irregularities are alleged in preparation of voters' list, it is apparent that when only polling is now left, this Court cannot in writ jurisdiction interfere in the matter.
15.4WP.2073.15 In this situation, with liberty to petitioner to renew his grievance after result of election is declared, we dispose of Writ Petition. No costs.
