The application for amendment moved after the commencement of trial without making the pleading as in respect of due diligence as required as per the proviso to Rule 17 of Order VI of Code of Civil Procedure, came to be rejected on the ground of delay as observed in paragraphs 7 and 8 of the order.

I do not find any error committed by the learned Trial Court in rejecting the application.

Accordingly, the writ petition is dismissed.
