IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR WRIT PETITION NO. 5626 OF 2021 Sachin Suresh Bangre__ Vs. __MSPGCL and anr --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. A.B.Patil, Advocate for Petitioner CORAM :
AVINASH G. GHAROTE, J.
DATE : 02/01/2023 Mr. Patil, learned counsel for the petitioner fairly does not dispute that on the date of the application, the petitioner was not qualified for the post of Artisan 'C', as the certificate based upon which the application was made was found to be invalid by the report at Exh. 48 issued by the Regional Office of Vocational Education and Training and therefore, in that light the award dated 4.7.2019 is not disputed. His only contention is that since the requisite qualification has been acquired subsequently, the petitioner would be entitled to apply afresh considering that his land has been acquired.
The impugned award dated 4.7.2019 in light of the above statement cannot be faulted with. The petition therefore is without any merit and is accordingly dismissed.
(2) 68wp5626.21 Needless to say that if the petitioner qualifies for the post on account of he being a displaced person and his subsequently acquired qualification he would be entitled to apply as and when the advertisement is published.
