Heard Shri S. Patrikar, learned Counsel for the applicant and Shri H.D. Dubey, learned A.P.P. for respondent no.1.

We find that a charge-sheet is already presented to the Court of Judicial Magistrate First Class, Hingna, District Nagpur on 30.11.2010, and a Regular Criminal Case No.179/2010 is going on. 3.

Effort of learned counsel for the applicant is to demonstrate that no case is made out for prosecuting the applicant.

Learned A.P.P. appearing on behalf of respondent no.1 states that FIR is dated 08.01.2010,

Order 0907apl247.15 and therefore, period in excess of 5 1⁄2 years has expired, hence this Court has been approached belatedly.

In this situation, we are not inclined to interfere in extra ordinary jurisdiction. However, considering the request made by the learned counsel for the applicant, that the applicant comes from Bangalore, we expedite the proceedings pending on the file of Judicial Magistrate First Class, Hingna. The said proceedings be decided finally at the earliest and in any case within a period of six months from the date of communication of this order to it.

With this direction, the application is disposed of. No costs.
