Arrest of applicant in C. R. No. 95/2019 by Kurkheda Police Station relating to offence punishable under Sections 395, 392, 342, 504, 506, 34 of the Indian Penal Code has occasioned applicant to approach for bail on rejection by Sessions Court.

It is the case of the prosecution that on 05.09.2019, the informant along with his father was traveling by car towards Gewardhara Road. While they reached at Khairi Tolla area, four persons came in Mahindra Car and and accosted them. All the four persons alighted from Car and by giving threat looted cash amount of Rs. four lakhs from the informant. Pertinent to note that all the four assailants were known to the informant since there names were very much mentioned in the FIR. The applicant Saurabh is other than those four persons. Neither informant nor his father stated that somebody also accompanied those four assailants which excludes the participation of any stranger.

Though the State resisted bail, perusal of reply, nowhere indicates any incriminating material against the applicant rather his connection with the incident. Prima facie, there is no material against the applicant. In the circumstances, The applicant can be released on
bail by putting certain conditions. Hence following order:- 6.
Bail application is allowed.

The applicant - Saurabh S/o Yudhistir Raut is released on bail on his furnishing P.R. Bond of Rs. 25,000/- with one or two sureties in the like amount.

The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case. 9.
The applicant shall not change his place of residence without prior intimation to the concerned Investigating Officer.
10.
This order be communicated to the counsel appearing for the parties, either on the email address or on WhatsApp or by such other mode, as is permissible in law.
